Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Earls Court provides gardening and related outdoor maintenance services to residential and commercial customers. By making a booking, confirming a quotation, or allowing our team to begin work, you agree to these Terms and Conditions. Please read them carefully before placing an order for services.

These terms are intended to apply to gardening services carried out in Earls Court and surrounding areas within our normal service area. The exact scope of work, timing, pricing, and any special requirements will usually be confirmed in writing before work begins. If there is any inconsistency between these Terms and Conditions and a written quotation or service agreement, the written quotation or service agreement will prevail to the extent of that inconsistency.

1. Service Overview

We provide a range of gardening and outdoor maintenance services, which may include lawn care, hedge trimming, pruning, planting, weeding, garden clearance, seasonal tidy-ups, pressure washing of suitable surfaces, green waste removal, and general garden maintenance. The precise services to be delivered will depend on the quotation, site assessment, and any instructions provided by the customer.

We will carry out our work using reasonable skill and care. Where a service outcome depends on weather, plant condition, soil condition, prior maintenance, accessibility, or the age and health of plants, we cannot guarantee a specific result. Gardening is a living service and outcomes can be affected by factors outside our control.

2. Booking Process

A booking may be made after an initial enquiry and any required site visit, photo assessment, or discussion of the work. We may provide an estimate or quotation based on the information available at the time. Where necessary, a final price may be confirmed after inspection of the site or once the work has begun and the full extent of the task is clear.

A booking is accepted only when we confirm it. Confirmation may be given in writing or by another clear method of communication. We reserve the right to decline a booking if the requested work falls outside our capabilities, our service area, our scheduling capacity, or where the site conditions present unacceptable risk.

The customer must provide accurate information during the booking process, including the nature of the work required, access arrangements, parking or loading restrictions, known hazards, and any relevant site details. If the information provided is incomplete or inaccurate, this may affect timing, pricing, or the ability to complete the work as originally planned.

Customers must ensure that someone authorised to approve the work is available, where needed, and that access to the property and work area is available at the agreed time. Delays caused by missed access, restricted access, or incorrect information may result in additional charges or rescheduling.

3. Quotes and Prices

Any price indication given before a site visit is an estimate unless stated otherwise. Quotations are generally based on the scope of work described by the customer and the conditions observed at the time of inspection. If the customer requests additional work, or if hidden conditions are discovered, we may revise the price before proceeding with the extra work.

Prices may be calculated on a fixed-price basis or on a time and materials basis, depending on the nature of the service. Where the work is charged by the hour or part hour, time spent travelling between tasks on the same visit, setting up equipment, clearing debris, and related work may be included where reasonable and explained in advance.

Unless otherwise stated, quotations remain valid for a limited period from the date issued. We may withdraw or revise a quotation if there is a change in the scope of work, access conditions, material costs, waste disposal charges, or other relevant factors.

4. Payments

Payment terms will be confirmed at the time of booking or in the quotation. Unless otherwise agreed, payment is due on completion of the work or within the timeframe stated on the invoice. We may require a deposit for larger, repeat, seasonal, or specially ordered jobs.

We accept payment by the methods we make available at the time of invoicing. Payment must be made in full and without deduction unless a different arrangement has been agreed in writing. If payment is not received by the due date, we reserve the right to charge reasonable recovery costs and interest on overdue sums in accordance with applicable law.

If the customer disputes any part of an invoice, they should notify us promptly and provide details of the issue. Undisputed amounts remain payable on time. We are not obliged to begin or continue work if previous invoices remain unpaid.

5. Cancellations and Rescheduling

If you need to cancel or reschedule a booking, please notify us as soon as possible. We understand that circumstances change, but late cancellations can prevent us from offering the appointment to another customer and may create avoidable costs.

Where a booking is cancelled with little notice, a cancellation charge may apply if we have already allocated staff time, purchased materials, arranged waste disposal, or travelled to the site. The amount charged will be reasonable and proportionate to the loss incurred. If work has already started, you may be charged for labour, materials, and any completed part of the service.

We may reschedule a booking if weather conditions, safety concerns, access problems, staff availability, equipment failure, or other circumstances beyond our control make it impractical or unsafe to proceed. We will aim to give reasonable notice and offer an alternative date where possible. We are not liable for any indirect loss arising from a rescheduled appointment, provided we act reasonably.

6. Customer Responsibilities

The customer is responsible for ensuring that the garden and surrounding areas are safe and accessible. This includes securing pets, removing valuable or fragile items from work areas, alerting us to hidden hazards, and ensuring that any access gates, paths, or communal areas can be used safely.

The customer must identify any underground services, irrigation systems, fragile edging, concealed cables, asbestos, or other hazards that may affect the work. If we discover a hazard that has not been disclosed, we may pause or stop work until the issue is resolved. Additional time spent dealing with undisclosed hazards may be chargeable.

Where the customer provides plants, materials, fixtures, or equipment for the job, the customer remains responsible for their suitability unless we have specifically agreed to supply and select them. Any instructions relating to plant care, pruning, cutting height, or treatment methods should be given clearly before work begins.

7. Liability and Limitations

We will use reasonable care and skill in providing our services. However, gardening work involves inherent risks, including the possibility of minor plant damage, surface marking, debris spread, breakage of brittle materials, or changes to the appearance of cut or pruned plants. We are not responsible for normal and expected consequences of the agreed work, provided it is carried out competently.

We are not liable for loss or damage caused by events outside our reasonable control, including severe weather, subsidence, pre-existing defects, hidden decay, pest infestation, disease, or the condition of plants and materials before the work begins. We are also not liable for indirect or consequential loss, loss of use, loss of profit, or loss of enjoyment, except where such limitation is not permitted by law.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded under the laws of England and Wales.

If property damage is caused by our proven negligence, our liability will be limited to the reasonable cost of repair or replacement, taking into account wear, age, condition, and depreciation, subject always to any rights the customer may have under law. Customers should notify us of any issue as soon as reasonably possible so that we can inspect and, where appropriate, seek to resolve it.

8. Waste Regulations and Garden Waste Disposal

Where we remove garden waste, we will handle and dispose of it in accordance with applicable waste laws and environmental requirements. Green waste may include grass cuttings, branches, leaves, hedge trimmings, and similar organic material. Waste that cannot lawfully be mixed with green waste, such as chemicals, oils, paint, rubble, asbestos, electrical items, hazardous materials, or general household rubbish, must not be placed in the garden waste stream unless we have expressly agreed otherwise and it is lawful to do so.

The customer must disclose any waste that may be hazardous, restricted, or unusual. If such waste is found during a job and was not previously disclosed, we may stop work or arrange separate handling at additional cost. We reserve the right to refuse to remove any item or material that we believe may be unlawful, unsafe, or outside our waste handling arrangements.

Where waste is transferred for disposal, we may use licensed carriers, facilities, or disposal routes. Customers should be aware that some waste removal charges reflect not only labour but also transport, sorting, tipping fees, and compliance costs. If the customer chooses to retain waste on site, it becomes the customer’s responsibility once work has been completed and the waste has been left in the agreed location.

9. Access, Delays, and Site Conditions

If access is delayed by the customer, by building works, by communal restrictions, or by parking or loading limitations, we may need to adjust the job timetable or charge for waiting time where appropriate. We will always aim to act fairly and keep disruption to a minimum.

Where site conditions differ significantly from what was described, we may need to modify the scope of work, change the tools used, or halt the job if it becomes unsafe or impractical. In such cases we will explain the reason for the change and any revised charge before continuing where possible.

10. Complaints

If you are unhappy with any aspect of our service, please tell us promptly so we can investigate and, where appropriate, put matters right. Complaints should be raised as soon as reasonably possible after the service has been completed. We may request photographs, a description of the issue, or an opportunity to inspect the work in person.

We will consider complaints in good faith and aim to resolve them fairly and promptly. This process does not affect your statutory rights.

11. Governing Law

These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and interpreted in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory consumer rights or legal protections that apply.

12. General Provisions

If any part of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in full force and effect. No failure or delay by us in exercising any right or remedy shall operate as a waiver of that right or remedy.

We may update these Terms and Conditions from time to time to reflect changes in our services, legal obligations, or business practices. The version in force at the time of booking will apply to that booking unless a change is required by law.
